On 11 February 2022, standard direction order templates to use in multi-track clinical negligence cases being heard in the county courts and district registries or Royal Courts of Justice were updated. They were first published on 30 January 2017.
These changes will be of particular interest to all legal practitioners specialising in the field of clinical negligence.
Of particular note is the emphasis on reducing ‘door of the court’ settlements. These are considered wasteful of costs, resources and judicial time. Any party not engaging in any means of Alternative Dispute Resolution proposed by another party is to serve a witness statement giving reasons within 21 days of receipt of that proposal.
