Andrew Morse

Personal injury litigation is Andrew’s principal area of practice.  He is experienced in all types of personal injury litigation, including employers’ liability, occupiers’ liability and road traffic accidents.  Andrew regularly conducts CCMCS, JSMs and trial work.  He has a busy paperwork practice advising on all aspects of the practice area and notable experience in drafting high value schedules of loss.  He is currently instructed in a number of high value cases in which he has been involved from the outset, advising on appropriate courses of action from an early stage.

Andrew has a developing clinical negligence practice acting for both Claimants and Defendants.  He has experience in attending mediations and settlement meetings in a broad range of clinical negligence cases including negligent surgical procedures and cases of delayed/missed diagnoses.  His ongoing work includes a negligent medical treatment claim, resulting in death, which is pleaded in excess of £2 million. Andrew represented the family at the inquest.  Andrew also has considerable experience of representing health professionals at inquests and disciplinary hearings which has assisted in broadening his knowledge of the practice area.

Andrew has received regular instructions in cases of noise induced hearing loss and hand arm vibration syndrome claims.  He is experienced in dealing with medico-legal issues arising in such cases and with cross-examining experts at trial.

Andrew’s practice in recent years has included regular instructions to represent interested parties at inquests.  He is currently briefed to represent a Welsh Health Board in an inquest into the deaths of two nurses from Covid-19.  He is also briefed to represent the Fire Brigades Union in an inquest in West Wales into the death of a firefighter on a training exercise.

He has appeared at inquests into deaths in custody, deaths in care homes and deaths arising from negligent medical treatment.  Instructions to act for bereaved families are often the start of his involvement in actions leading to damages claims.

Andrew has considerable experience of advising Claimant’s in cases involving allegations of dishonesty and fraud.  He has experience of dealing with LVI cases and claims involving the use of surveillance and social media evidence.  Andrew’s practice has primarily focused to date on Claimant instruction and advisory work in cases where allegations of fundamental dishonesty are raised.  He is experienced in dealing with medical experts asked to comment on allegations of dishonesty, particularly where surveillance evidence is deployed in individual cases.  In his earlier years of practice Andrew appeared in numerous criminal fraud cases both prosecuting and defending.

Andrew has experience in dealing with personal injury claims arising from accidents abroad, including road traffic accidents abroad, holiday sickness claims and claims involving the applicability of the Package Travel Regulations.
