Farrar’s Building commercial barristers have extensive experience and expertise in dealing with a broad range of commercial disputes. Our commercial practice includes all forms of contractual dispute, for example claims relating to the sale of goods, supply of services and agency agreements, fraud, property damage, banking and finance, directors’ duties, shareholder disputes, guarantees and corporate insolvency.

Our commercial clients range from individuals and entrepreneurs to multinational companies and insurers. The issues arising often include complex contractual arrangements for the provision of services to Local Authorities and in relation to public procurement. These claims often dove-tail with other areas of work undertaken by members of chambers such as in relation to claims for property damage, personal injury and contractual indemnity between co-defendants.

Our members’ experience includes contractual disputes in relation to the supply of goods and services that in the commercial context includes the provisions of the Sale of Goods Act 1979, Supply of Goods & Services Act 1982 and the Unfair Contract Terms Act 1977. In the consumer context claims concern the Consumer Rights Act 2015. Common law negligence also arises in such claims, including those for product liability in the consumer and commercial contexts, and claims pursuant to the Consumer Protection Act 1987 and the Electrical Equipment (Safety) Regulations 1994.

Commercial disputes include construction and building contracts in the commercial and domestic contexts, including the interpretation of JCT standard form contracts (Minor Works, Design & Build etc.). Disputes includes those in relation to housing, commercial property, shops, hotels, farms and farming contracts and sub-contracts, including those involving dairy and cereal farming.

Members’ commercial instructions often give rise to insurance and coverage issues, including joint insurance and co-insurance. Members experience in the insurance context compliments instructions received in commercial disputes. Members appear in the Commercial Court and the Circuit Commercial courts, as well as the Technology & Construction Court, and County Courts around the country.
